NOMENCLATURE
"Client" shall herein
refer to the person(s) engaging the services of Music of
Measure.
"Performer" shall refer
to anyone engaged by Music of Measure for the purpose of
fulfilling the engagement as contracted between the Client and
Music of Measure. This shall include any individual(s)
engaged by the Performer to assist in the execution of the
Performer's duties under the contracted engagement.
PRICES
So many variables
contribute to making each booking unique. However, for
the purposes of guidance only, prices normally start in the
region of £60.00 per Performer per hour, according to time of year (i.e. New
Year's Eve compared with a weekday in February), duration of
booking, weekday/weekend, venue accessibility,
preparation/set-up time, number of performers, and excluding any additional
and unusual requests or arrangements.
Discounts: available for
day-rates and regular bookings (hotels, clubs, restaurants,
bars, venues, exhibitions, corporate hospitality suites
etc.). Also, for smaller events (less than 35
persons) where a lighting system and full PA may not
required.
A PA
system of up to 900-watt RMS, with optional lighting, is
available, where Music of Measure deems it necessary
for the purposes of performance and quality control, and
only where payment in full has been received.
All prices quoted are for
performance at venues situated within a 30-mile radius of
Cambridge. Travel to locations beyond a 30-mile radius of
Cambridge, shall normally attract an additional fee
calculated at £1.00 per additional mile in geographic
distance, per Performer, to offset cost of travel and time. E.g. travel to
London (60 miles from Cambridge, with the first 30-miles
travel being free of charge) would incur an additional
fee of £30.00 per Performer.
Additional special
arrangements, e.g. additional personnel, extra equipment-hire
for larger venues, requests for music outside the repertoire,
extended travel arrangements, etc., will be quoted for
separately, multi-point performance etc..
CONDITIONS
It will be the
responsibility of the Client to properly inform Music of Measure
of the size and nature of the venue. Where required, the
Client shall be responsible for the cost of provision of
additional sound
reinforcement equipment sufficient for the size of venue
where it exceeds the scope of the PA system operated by
Music of Measure, and as
deemed necessary according to the quality-control standards operated by Music of
Measure. Also, the Client
shall furnish a ready electrical supply, sufficient to the
purpose of powering any and all equipment necessary to the performance,
as defined by Music of Measure at time of booking.
Each hour of
contracted performance shall include a rest period for the
Performers, of not less than ten-minutes nor more than
fifteen-minutes duration, which may be waived or combined
at the Performer's sole discretion, in consultation with
the Client. It shall be expected that the Client will
provide Performers with ready and reasonable access to
refreshments and available catering, during breaks in
performance, and without charge.
A £30.00 non-refundable
booking-fee will be required. In addition, 50% of the
engagement-fee shall be required within 7days to secure the booking,
with the remaining 50% to be paid in full no later than 14 days prior
to the date of the engagement.
The Client may cancel at
any time, forfeiting the £30.00 booking-fee, and additionally
subject to the following conditions:- cancellations within 30 days of
the appointed engagement, shall result in the forfeiture of 50%
of the engagement-fee; cancellations within 14 days of the
appointed engagement, shall result in the forfeiture of 100% of
the engagement-fee for the cancelled engagement.
Music of Measure reserves
the right to alter or cancel any engagement at any time, and
will refund any monies received from the client in respect of an
engagement thus cancelled.
Force Majeure:
Music of Measure cannot be held responsible for
any alteration to the contract arising from circumstances
which, and as defined by Music of Measure, lie beyond its control,
to whatever extent or degree.
In any event, the
extent of Music of Measure's liability shall not exceed the
amount by which it has been placed in funds by the client,
excepting where subject to the terms and conditions
expressed herein.
The Client undertakes
to ensure the safety of the Performers, and their equipment,
whilst in the execution of their duties under cover of the
engagement, and further that a suitable and safe venue, with
shelter from the elements, together with the necessary
appurtenances, are provided. The Client agrees to
furnish the Performers with exclusive use of a secure
area for changing and storing of personal effects, other
equipment etc.
The client shall
indemnify Music of Measure and/or any of the Performers
engaged by us on the Client's behalf for the purpose of the
contract, against any and all claims brought by any party,
for whatever reason, where the grounds for any such claim
may be considered to arise from events indirectly
and/or directly
relating to the engagement.
These terms reflect
the general tone of the agreement between the Client and
Music of Measure, and are not to be considered comprehensive
or exclusive in their scope.
Music of Measure
reserves the right to revise the terms expressed herein at
any time, at its own discretion, without notice.
